Eligibility to participate in Media Engine Services
- Users must have a valid mobile network operator connection and a mobile phone within the country of purchase
- Users must be 18 years of age or older. Users under 18 years of age must have a parent or guardian’s permission to use the service.
- You must seek bill payer's permission before purchase.
- Users must understand and accept general and competition-specific rules, terms and conditions upon entering a competition.
- By entering a competition, the player warrants that he has the rights to enter the competition and that they understand and accept the terms and conditions of Media Engine competitions, including the right of Media Engine to send marketing messages in accordance with the guidelines.
GENERAL TERMS & CONDITIONS
BEFORE YOU USE OUR SERVICE, YOU MUST READ THESE TERMS AND CONDITIONS ("TERMS") CAREFULLY. BY USING OUR SERVICE, YOU AGREE TO THESE GENERAL TERMS AND CONDITIONS; IF YOU DO NOT AGREE THEN DO NOT USE THE SERVICE. The following General Terms and Conditions (“T&Cs”) are applicable to the products and services supplied via Short Messaging Services (hereinafter to be referred to as “SMS”), GPRS and 3G by Media Engine, or enterprises affiliated to it (“Media Engine”). Media Engine is permitted to amend these T&Cs from time to time without notice. Apart from the T&Cs, any applicable and published rules, promotional conditions, guidelines and provisions pertaining to the services also apply to you and the Media Engine upon the use of the services (as defined herein) of the Media Engine. All those guidelines, rules, promotional conditions and provisions will be considered an inextricable part of these General T&Cs. By availing yourself to use the services of Media Engine, you agree to be bound by these T&Cs and the guidelines, rules and promotional conditions from Media Engine.
1. Service Description
Media Engine provide mobile entertainment content, such as tones, games, applications, graphics and other data through its online and SMS services to compatible mobile devices. After registration and payment, you will be able to download or receive Products through the Service to compatible mobile phones. The services provided by Media Engine may also include access to products and services of third parties.
2. Availability
The Service is supplied "as is" (at the stage of development it happens to be in) and Media Engine accepts no liability nor does it issue any guarantees or warranty in the event that personal configurations, information or messages are not saved, or not saved in due time, or if they are deleted or incorrectly delivered. In order to subscribe to the Service, you are required to have access to the Internet and/or a mobile communications subscription and pay any service fees associated with such access. You are required to pay all expenses incurred in creating such access. You are also responsible for seeing to the connection of any necessary equipment, including any mobile telephone or personal computer or whatever devices that may be necessary needed and are in working order and suitable for use in connection with the Service.
3. Charges
You have access to our online services free of charge. With regards to the Services and the use of it, you shall pay the amount corresponding to the applicable rates of the Media Engine in force at that time and according to the rates charged by your mobile operator. The charges shall be invoiced to you via your mobile operator through the mobile bill you receive from the mobile operator of your network. You pay the Media Engine all national and local or other taxes, including but not restricted to GST, any taxes or levies imposed in lieu thereof, which taxes are based on the costs due to the use of the Services, regardless of whether those taxes are levied either now or in the future by local or national or by any other body or bodies authorized to levy taxes. Media Engine reserves the right to change the rates for the Service by posting details of such changes on its website. All rates, including rates for existing subscription contracts, are subject to change upon notice from Media Engine. Media Engine will provide you with reasonable notice of such change. If you do not accept the new fees (which will be applicable on a prospective basis only), you may cancel your subscription and/or your account effective immediately upon termination.
4. Prohibition of resale of the service
You acknowledge and agree that the Download(s) made available as part of the Service are owned by Media Engine, its affiliate and/or licensors, as applicable, and are protected by intellectual property laws. Media Engine hereby grants, and you hereby accept, a limited, non-exclusive, non-transferable, revocable license to download and use the Download(s) and the Service on a designated compatible mobile device solely for your own personal non-commercial use. You further acknowledge and agree that you may not reproduce, modify, perform, transfer, distribute, sell, create derivative works of or otherwise use or make available the Download(s) except as expressly provided in this Agreement.
5. Intellectual property rights
Except as otherwise set forth herein, all right, title and interest in and to any intellectual property, proprietary rights or other rights related to intangible property which are used, developed, comprising, embodied in, or practiced in connection with any of the Service ("Media Engine Intellectual Property Rights") are owned by Media Engine or its licensors, and you agree to make no claim of interest in or ownership of any such Media Engine Intellectual Property Rights. You acknowledge that no title to the Media Engine Intellectual Property Rights is transferred to you, and that you do not obtain any rights, express or implied, in the Service, other than the rights expressly granted in this Agreement. Tones and sounds are performed by impressionists, they do not carry the approval or endorsement of the celebrity involved or any broadcasting institution.
6. General rules regarding use and saving of information
You acknowledge that Media Engine collects and processes personal, financial and usage information, subject to the rest of this paragraph in order to operate this site. Personal information collected by Media Engine may be stored and processed in Singapore or any other country in which Media Engine or its agents operates. By using the Service, you consent to any such transfer of information outside of your country. We may pass on your personal information to your mobile phone service provider to secure collection of fees. Further, we may pass on your information to governmental agencies, including but not limited to courts and district attorneys' offices, for legal proceedings and the prevention of crimes.
7. Alterations to the service
Media Engine may at any time alter or terminate the Service, or any part of it, either temporarily or permanently. You agree that the Media Engine is not liable to any third party or you as a user in the event that the Service is altered, terminated or suspended.
8. Transactions with advertisers/sponsors
Any dealings performed between you and sponsors and/or advertisers, or any participation in promotions by sponsors and/or advertisers that have been located on the Service, including the supply and payment of goods or services, as well as all other guarantees, terms and conditions and statements issued in connection with those transactions are the exclusive concern of you and the sponsor and/or advertiser. You agree that Media Engine is not liable or responsible for any damage of any nature whatever that may be the result of such transactions or the presence of those sponsors and/or advertisers on the Service.
9. Activation of services
Any dealings performed between you and sponsors and/or advertisers, or any participation in promotions by sponsors and/or advertisers that have been located on the Service, including the supply and payment of goods or services, as well as all other guarantees, terms and conditions and statements issued in connection with those transactions are the exclusive concern of you and the sponsor and/or advertiser. You agree that Media Engine is not liable or responsible for any damage of any nature whatever that may be the result of such transactions or the presence of those sponsors and/or advertisers on the Service.
10.Termination of services

The termination shall become effective immediately upon receipt of termination request. Charges may still appear on your mobile phone bill the following month as mobile operators bill retrospectively. Media Engine reserve the right to collect any monies owed.
Dispute of billing charges will be given due consideration in relation to circumstances however, please note after the first use of the Service, you acknowledge and agree to waive any right of withdrawal. However, you can choose to unsubscribe from the service at any time.
11. Interruptions or Discontinuation of Service.
Media Engine may suspend the Service for repair, maintenance, and/or upgrade work. In such event, Media Engine shall make reasonable efforts to keep the said interruption as brief as is reasonably possible with as little inconvenience to you as is reasonably possible. Media Engine reserves the right to modify or discontinue, temporarily or permanently, individual services provided by it or third parties via the Services, or the Services themselves.
12. Security & Protection
The infrastructure and programmes are constructed and protected in such a way that it can be reasonably assumed that unauthorized persons cannot gain access to any information about users. Please refer to the general T&Cs regarding liability of Media Engine. Acceptance of this policy means Media Engine:
- may use the information or a combination of it to execute the agreement between you and Media Engine, and to allow you the best possible use of the Media Engine website;
- may re-use the information communicated by you on the site or via SMS;
- can inform you about offers, discounts, new developments and additional services offered by the Media Engine;
- may process the information in connection with the formation or maintenance of a direct relationship between Media Engine and/or enterprises selected by it and you for the purpose of recruitment for commercial or charity. By you agreeing to the terms, Media Engine may take that information and use it or offer it to third parties in anonymous form.
